This document outlines the Terms and Conditions for the use of MGH’s Subscriber Website, located at https://milkygemhunter.io/.

 

Introduction

1. By accessing this website you are accepting all Terms and Conditions contained wherein.
2. For the purpose of clarity the term “MGH” is used to represent all terms associated, including but not limited to: MGH, MGH Consulting, Milky Gem Hunter, MGH Pioneers, Milky; and any associated stakeholders and affiliates operating under the MGH brand.
3. For the purpose of clarity “FA” means Fundamental Analysis.
4. For the purpose of clarity all monetary values in these Terms and Conditions with the currency symbol “£” refer to GBP, otherwise known as “Great British Pounds” or “Sterling”.
5. For the purpose of clarity an “MGH Executive” refers to a board member of MGH, acting with consent upon a board vote.
6. The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log onto this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client; In the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing laws of England, or where applicable the laws of the United Kingdoms of Great Britain and Northern Ireland. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore are referring to the same.
7. Do not continue to use MGH if you do not agree to all of the Terms and Conditions contained wherein.

8. We employ the use of cookies. By accessing MGH, you agreed to use cookies in agreement with the MGH's Privacy Policy.
9. Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.

 

 

Proprietary Rights:

10. MGH, and everything incorporated or used in connection with MGH, including but not limited to: web sites; software; hardware; data; reports; designs, graphics, text, methods, processes, technology, and other intellectual property; are owned exclusively, or authorized for use, by MGH. By using MGH, User(s) acknowledges such ownership. Except as expressly permitted in these Terms and Conditions; or upon signed or stamped written agreement from an MGH Executive. Any attempt by an individual or commercial entity who claim any MGH intellectual property as their own, will be subject to litigation and agree a fixed penalty notice of no less than £100,000. MGH may seek also reparations to the value of 100% of gross revenue generated as a result of above stated violations, of the guilty party, from the date of violation.
11. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way, content published by MGH, or any information contained therein without the prior signed or stamped written consent of an MGH Executive. You do not acquire any right, title or interest in such materials by virtue of accessing MGH or making permitted uses allowed under these Terms of Service. Any violation of this may result in litigation with the guilty party agreeing to a fixed penalty of no less than £10,000.00 per violation.
12. All content contained within the https://milkygemhunter.io website, including the content within the publicly accessible areas of the website, and it’s subscriber panel, including but not limited to: FA Reports; FA Certificates; Blog posts; Educational articles; Tutorial videos; Feedback submitted by 3^rd parties; Milky’s Altcoin Picks and other content not yet released or published at the time of writing (01.09.2023), are for personal consumption only as per clauses 10 & 11 of these Terms and Conditions. Any commercial entity, or an individual acting on behalf of a commercial entity who has subscribed to https://milkygemhunter.io without a commercial agreement with MGH, and uses any of the content contained within for commercial purposes of any kind, will be subject to litigation and agree to pay a fixed penalty of no less than £25,000.00. MGH may also seek reparations to the value of 100% of gross revenue generated after commercial use of the content described above of any kind, from the date of the unauthorised subscription, or date when unauthorised use of proprietary content was verified from.

 

Hyperlinking to our Content

13. The following organizations may link to our Website without prior written approval:
    1. Government agencies;
    2. Search engines;
    3. Media organisations;
    4. Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and
    5. System wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.
14. These organizations may link to our home page, to publications or to other Website information so long as the link:
    1. Is not in any way deceptive;
    2. Does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services;
    3. Fits within the context of the linking party’s site.
15. We may consider and approve other link requests from the following types of organizations:

18. If you are one of the organisations listed in clause 14 above and are interested in linking to our website, you must inform us by sending an e-mail to MGH via info@mghconsulting.io. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Please wait up to 21 days for a response.

22. We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libellous, obscene, or criminal; Or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights

24. We reserve the right to request that you remove all links, or any particular link to our Website. You approve to remove all links to our Website upon request within a period of no more than 24 hours. We also reserve the right to amend these terms and conditions and it’s linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking Terms and Conditions.
25. Removal of links from our website
26. If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly.
27. The content on MGH’s website reflects personal opinion. We always aim to ensure the accuracy of the content, but we cannot guarantee it. As such we do not guarantee that the information on this website is 100% accurate; We do not warrant its completeness or accuracy; We do not promise to ensure that the website remains available; Or that the material on the website is kept up to date.
28. MGH reserve the right to terminate accounts and access to anyone for any reason at any time.
    1. Should the reason of termination and access restriction occur as a result of unauthorised commercial entities, or individuals accessing on behalf of commercial entities, without signed or stamped authorisation in writing from an MGH Executive, they will be subject to the clauses of “Proprietary Rights” of these Terms and Conditions.
    2. Should an individual’s account be terminated due to suspected violations of our “Proprietary Rights”, they may be entitled to a refund at a pro-rata rate, from the date of their last billing date as outlined in the “Cancellation & Refunds” section of these Terms and Conditions. But the individual may still be subject to the clauses outlined in the “Proprietary” section of these Terms and Conditions”.
    3. Should an individual’s account be terminated due to suspected violations of other sections of our Terms and Conditions outside of “Proprietary Rights”, they may be entitled to a refund at a pro-rata rate, from the date of their last billing date as outlined in the “Cancellation & Refunds” section of these Terms and Conditions.
29. Each subscription model of https://milkygemhunter.io comes with an auto-renew recurring payment system, regardless of payment method used. By subscribing you are granting MGH authorisation to collect recurring payments via the payment method you’ve provided.
    1. The Lifetime subscription is exempt from this clause.

 

Cancellation & Refunds

30. MGH offers three tiers of subscriptions for it’s B2C (business to customer) customers/subscribers:
    1. One Monthly (otherwise known as Monthly), paid at a rate of 31 days per period
    2. Twelve Monthly (otherwise known as Annual or Annually), paid at a rate of 365 days per period
    3. Lifetime
31. In the event a “One Monthly” subscriber wishes to cancel their subscription they will not be liable for a refund of their most recent subscription payment.
    1. The cancellation ensures they will not be charged any further payments.
    2. Successful cancellations will ensure the subscriber can still access their subscription panel until the date of the current payment term expiry.
32. In the event a ‘Twelve Monthly’ subscriber wishes to cancel their subscription:
    1. All “Twelve Monthly” subscribers will not be entitled to a refund of their first billing cycle. Refund claims will only be eligible after the 2^nd subscription payment of their chosen subscription period has been collected/paid.
    2. Should a “Twelve Monthly” subscriber cancel their subscription within their first subscription cycle this will ensure no further payments are taken.
    3. Successful cancellations will ensure the subscriber can still access their subscription panel until the date of the current payment term expiry.
    4. Taking clauses 32a & 32b into consideration: To be eligible for a partial refund, a “12 Monthly” subscriber must make the request within 30 days from the last subscription payment taken. If the subscriber does not make the request within 30 days, they will not be entitled to a pro-rata refund for their current subscription period. An ineligible claimant requesting cancellation will only ensure future payments are not collected.
    5. The remaining balance of the subscription to be refunded for eligible claims shall be calculated on a pro-rata daily basis from the date of their last bill/subscription payment.
33. Lifetime subscribers have 30 days to request a cancellation of their subscription for a partial refund of 75% of the fee paid. The remaining 25% is calculated as the annual rate, thus will be retained.
    1. Any requests for cancellation of Lifetime subscriptions after 30 days will be rejected.
    2. Upon request for cancellation within 30 days, access to your subscription will be amended to expire after 1 calendar year.
34. The date of cancellation shall always be calculated from the date the request is sent by the subscriber, not the date MGH action upon the request.
35. In the event a Cancellation Request is not processed before the end of the subscribers current payment term, and a further payment is taken for a new payment term, the subscriber will be refunded in full the value of the new payment term prior to any further calculations of entitled refund (if applicable as per clauses 31 & 32).
36. Should a subscriber who originally subscribed with a discount code cancel their subscription, and then re-subscribe, they will not be entitled to the discount previously offered or applied.
37. All eligible claimants (as outlined in clauses 31 & 32) can process their cancellation directly with Stripe within the Account Panel of the Subscriber Panel.
    1. Should any technical issues arise which prevent this, an email to info@mghconsulting.io can be sent.
    2. If sending an email, to pass security for GDPR purposes you must:
       1. Send the email from the email address used when registering;
       2. Include the full name used when registering the account;
       3. Your unique account number;
       4. If no unique account number is provided to you, please use your full billing address.
    3. Should a cancellation request not comply with clause 37.b., a response will be sent to inform the sender they have failed security and the correct information must be included for any cancellation request to be processed.
38. An email will be automatically sent to each subscriber at least 7 days prior to their next billing cycle date, to inform them of the upcoming payment.
39. Any currently active 3-monthly subscribers maintain their rights as per Terms and Conditions dated December 19^th 2022 should they choose to continue their subscription.
    1. You will be notified 7 days prior to the next payment collection via email.
    2. You maintain the right to cancel at any time, but no refund will be offered for the most recent payment. Your cancellation request will stop further payments.
    3. In the event we have not processed a cancellation request in time to stop the next payment, clause 35 will apply.
    4. Access to your subscription panel will continue until your current payment term expires.
40. Should any subscriber have further questions regarding their Cancellation and Refund rights please don’t hesitate to contact MGH via the contact form within their Account Panel, or send an email to info@mghconsulting.io (including relevant information as per clause 37) and we will endeavour to respond within 10 days.

 

Service Level Agreements (SLAs)

40. MGH will endeavour to respond to the following:

1. B2B (Business to Business) Enquiries within 3 days
2. Complaints within 7 days
3. Cancellation / Refund Requests within 10 days
4. General Enquiries within 14 days

41. MGH are under no legal obligation to adhere to the above SLAs set out in clause 1
42. MGH can amend the SLAs stated in clause 40 at any time as per business needs
43. Should MGH not respond within SLA periods offered in clause 40, the customer will not be entitled to compensation of any kind
    1. MGH may offer a Gesture of Goodwill, but are under no obligation to do so
44. All enquiries, requests or complaints received shall be considered on an individual basis, and do not necessarily reflect or guarantee the same response from MGH even if from the same sender
    1. For example: If Subscriber A files a complaint they may receive a Gesture of Goodwill from MGH, If Subscriber A files another complaint they may not receive a Gesture of Goodwill.

 

Disclaimer

45. To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:
    1. Limit or exclude our or your liability for death or personal injury;
    2. Limit or exclude our or your liability for fraud or fraudulent misrepresentation;
    3. Limit any of our or your liabilities in any way that is not permitted under applicable law; or
    4. Exclude any of our or your liabilities that may not be excluded under applicable law.
46. The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer:
    1. Regarding subject to the preceding paragraph;
    2. Govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.
47. We will not be liable for any loss or damage of any nature.
48. Accuracy and Currency of Information:
